Condition of Use

Please read these Terms and any other terms of use posted on the Website as together they form our Website Terms governing your utilization of our Website and Website services. We may change these Website Terms from time to time without notice to you by posting the updated Website Terms on the Website, so please be sure to check regularly for updates. When you place an Order through our Website, you are deemed to have consented to the latest version of the Website Terms then posted on our Website. If a change in law means that we have to change our Website Terms after you have placed an Order but before it has been fulfilled, we are obliged to apply that change to your Order. In all other cases, the version posted at the time your Order was placed will apply. If you do not agree to be bound by the Website Terms, you should not use the Website. 

Eligibility

We aim to make the Website and its associated services available to as many of you as possible. However, we do require that you are at least 18 years of age, able to lawfully: (i) make payment through one of our accepted tender types; (ii) agree to these Terms; and (ii) enter into binding Orders with us.

Registration

In order to take advantage of the features and services of this Website, you can either utilize the Website) on a “guest check-out" basis or create an Account and register your details with us. If you are a Google or Facebook member, you may also login using your Google and/or Facebook membership details. It is your ongoing responsibility to make sure that any personal and payment details you provide to us are valid, accurate and complete. You can update your details by contacting us on email terry@oceanflysports.com or updating them in your Website profile. Please keep your account details and password confidential and secure. Our customer service agents will never ask you for your password. We are committed to complying with our Privacy Policy but are not responsible for any loss suffered through misuse of those details. Please notify us as soon as possible if you believe your account has been compromised. By registering or placing an Order on the Website you warrant that you meet the eligibility criteria described above and that the information you provide is yours and is accurate in all respects. Commercial entities are not eligible to register with us.

What information do we collect?

Your privacy is very important to us. We are providing this policy to inform you how we use the information we collect, the choices you have concerning the collection and use of such information, and disclosure of information on our service.

We collect information from you when you register on our THIS site, place an order, subscribe to our newsletter, respond to a survey or fill out a form.

When ordering or registering on our Site, as appropriate, you may be asked to enter your: name, e-mail address, mailing address or phone number.

Google, as a third-party vendor, uses cookies to serve ads on any sites that you visit. Google's use of the DART cookie enables it to serve ads to users based on their visit to sites. Users may opt out of the use of the DART cookie by visiting the Google ad and content network privacy policy.

How we collect information:

We collect information in three basic ways:

  • We collect information that you voluntarily provide to become a registered user (“User”) of our Site.

  • We collect information when you register to join the Site by logging into an account that you already have with certain third-party social networking sites (“SNS”) (including, but not limited to, Facebook and Twitter) via our Site. If you are not currently registered as a User on the Site and you click on “Sign in Using Facebook,” you will first be asked to enter your Facebook credentials and then be given the option to register and join the Site.

  • When you browse or use the Site, technological tools including “Log Data” and “Cookies” collect certain information, as explained in the following section.

What information we collect and how we use it

  • Personal Information. When you register with us to become a registered User of the Site, we will ask you for certain information about you that can be used to contact or identify you (“Personal Information”) and to create you account on the Site (“User Account”). Personal Information may include but is not limited to, your name, gender, profile photo, free-form biography, location/hometown, website and email address. If you decide to create your User Account by logging into an SNS via the Site, you are using the Personal Information you have already provided to the SNS (such as your “real” name, email address and other information you make publicly available via the SNS) to create your User Account on our Site; the information we collect may depend on the privacy settings you have with the SNS, so please consult the SNS’s privacy and data practices. For example, by using Facebook Connect, you are allowing the Site to access the Personal Information in your Facebook account pursuant to the Facebook terms of use regarding your use of the Site via Facebook.

We use your Personal Information (in some cases, in conjunction with your “Non-Identifying Information,” see below) to provide the following services to you.

What do we use your information for?

Any of the information we collect from you may be used in one of the following ways:

  • To personalize your experience - your information helps us to better respond to your individual needs

  • To improve our website - we continually strive to improve our website offerings based on the information and feedback we receive from you

  • To improve customer service - your information helps us to more effectively respond to your customer service requests and support needs to process transactions

  • Your information, whether public or private, will not be sold, exchanged, transferred, or given to any other company for any reason whatsoever, without your consent, other than for the express purpose of delivering the purchased product or service requested.

  • To administer a contest, promotion, survey or other site feature to send periodic emails

  • The email address you provide for order processing may be used to send you information and updates pertaining to your order, in addition to receiving occasional company news, updates, related product or service information, etc.

  • You will not be sent any unsolicited material unless you indicate that you want to receive details about products, offers, and events when you register on the Site.

WARRANTIES,DEFECT OR DAMAGE TO YOUR PRODUCT 

  1. Warranty.  Probably! most items are protected by a manufacturer’s warranty for at least the first year (and a lot have lifetime warranties). If for any reason, you’re unhappy with products please reach to us by email terry@oceanflysports.com We can find your warranty information and help you to contact the manufacturer.

  2. Not all products are covered by the warranty, always check the product page or contact us to know if it includes warranty benefits.

  3. Warranty Period. Repair or replacement under the terms of this warranty does not provide the right to extension or renewal of the warranty period. Warranty terms are in accordance with your product manufacturer. For more details about the specific terms of the warranty for your device, please visit the support page of your product.

  4. Warranty Not Applicable. The warranty does not apply in the following circumstances:

    1. if a repair has been attempted by any service center not authorized by the product seller; physical damage i.e. product presenting clear signs of damage like broken screens, heavy dents, bent products, that can prevent a product from functioning properly; liquid damage i.e. any situation involving the submersion or splashing of an electronic device in any liquid/or when water indicator (if any inside the device) changes color;

    2. original software alteration or modification.

    3. if the serial number is removed from the product;

    4. where there has been abuse or misuse of the product e.g. by not using it for its intended purpose or not in accordance with the manufacturer’s instructions on usage and maintenance;

    5. where there has been damage of a product’s battery caused by overcharging, failure to use in accordance with the specific instructions of core outlined in product user manual or where charged by chargers other than those approved by the manufacturer; and

    6. if any of the seals on the battery enclosure or cells are broken or show evidence of tampering.

    7. The customer must ensure the item is packed in its original box and wrapped safely. Ocean Fly Sports is not responsible for any damages that may occur during the shipping.

    8. Product having un-authorized repairs will not cover in warranty
